1. Acceptance of Terms

By accessing or using this website hosted via Zenler.com, you agree to be bound by these Terms & Conditions, all applicable laws and regulations, and accept responsibility for compliance with any applicable local laws. If you do not agree with these terms, you are prohibited from using or accessing this website. All materials on this website are protected by applicable copyright and trademark laws.

2. Use of materials & license

Permission is granted to access and use the materials on this website for personal, non-commercial, and transitory viewing only. This constitutes the grant of a license, not a transfer of ownership. Under this license, you may not: a) modify, copy, or reproduce the materials b) use the materials for any commercial purpose or public display c) attempt to decompile or reverse engineer any software used on this website d) remove copyright or proprietary notices e) transfer, share, resell, or mirror the materials on another server or platform This license terminates automatically if you violate these restrictions and may be terminated by Emotional Fitness at any time. Upon termination, all downloaded or copied materials must be destroyed.

3. Educational purpose & self-responsibility

All content provided by Emotional Fitness is for educational and informational purposes only. It does not constitute medical, psychological, therapeutic, legal, or professional advice. Participation in programs, courses, or content is voluntary and undertaken at your own responsibility. Emotional Fitness does not replace professional medical or mental health treatment.

All materials on this website are provided “as is”. Elysian Soulwork, LLC makes no warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights. No guarantee is made regarding the accuracy, completeness, or reliability of the materials or results obtained through their use.

5. Limitation of liability

To the maximum extent permitted by law, Elysian Soulwork, LLC shall not be liable for any damages arising from the use or inability to use the materials or services provided, including loss of data, loss of profits, or business interruption. Some jurisdictions do not allow limitations on implied warranties or liability; therefore, these limitations may not apply in full to all users.

6. Revisions and accuracy of content

The materials on this website may contain technical, typographical, or other errors. We do not warrant that any content is accurate, complete, or current. We may make changes to content at any time without notice and are not obligated to update materials.

7. Links to third-party websites

This website may contain links to external websites. Emotional Fitness is not responsible for the content, policies, or practices of any linked sites. The inclusion of any link does not imply endorsement. Use of external websites is at your own risk.

8. Instructor & content responsibility (Zenler compliance)

Where applicable, instructors represent and warrant that submitted content does not infringe upon third-party intellectual property rights. If HEVC compression technology is used, instructors are responsible for any applicable royalty payments to MPEG-LA or other rights holders.

9. Governing law

These Terms & Conditions are governed by the laws of the United States of America, unless mandatory legal provisions of another jurisdiction apply.

10. Cancellation, Rescheduling and Refund Policy

Appointment cancellations and rescheduling
Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled starting time.  

Cancellations or rescheduling requests made less than 24 hours before the appointment will be charged in full. For sessions booked as part of a package, the session will be considered used and deducted from the remaining package balance.  

If a client does not attend a scheduled appointment without prior notice, the session will be charged in full or deducted from the package.  

I understand that unexpected situations can arise. In exceptional circumstances, such as a medical emergency or a bereavement in the family, an alternative arrangement may be offered at my discretion.  Please notify me as soon as possible if you are unable to attend your appointment.  

Late arrival  
If a client arrives late, the session will usually end at the originally scheduled time so that the following appointments are not affected. The full session fee will still apply.  

If the delay makes it impossible to conduct the session meaningfully, the appointment may be treated as a late cancellation.  

Cancellation by the practitioner  
If I need to cancel or reschedule an appointment, the client may choose a new appointment time. If no suitable alternative can be found, any payment made for that session will be refunded or credited toward a future session.  

Package cancellations and refunds  
Package prices include a discount based on the purchase and completion of the full number of sessions.  If a client chooses to end a package early, sessions already completed will be recalculated at the regular single-session rate. Any remaining balance will then be refunded.  

In exceptional circumstances, such as a bereavement in the family, a different arrangement may be offered at my discretion.  Refunds will normally be returned to the original payment account or payment method to keep the payment process clear and straightforward.  Packages and unused sessions are not transferable to another person unless otherwise agreed in writing.

Package validity and transferability 
Packages are personal and may not be transferred to another person or animal unless otherwise agreed in writing.  The first session must be scheduled within four weeks of the purchase date. All sessions included in the package must be completed within three months of the first session.  

Clients are responsible for scheduling their sessions with sufficient time remaining before the package expiry date. Appointment availability cannot be guaranteed at short notice.  Any sessions not used within the validity period will expire and are not eligible for a refund, unless an extension has been agreed in writing before the package expires.  

In exceptional circumstances, such as a serious medical emergency or a bereavement in the family, the validity period may be extended at my discretion.
